The following privacy policy applies if you access our services via a web browser.

jobs.je (“the Website”) is a job site and this privacy policy explains how we use the personal information we collect about you when you use the Website. We are committed to respecting and protecting your privacy and the confidentiality of any information that we hold on you. We therefore process your personal data in accordance with the Data Protection (Bailiwick of Guernsey) Law, 2017 (DP Law).

Under the DP Law, the Website is a “controller”. This means that we are responsible for deciding how we hold and use personal information about you. This privacy notice applies to;

  • any person (Job Seeker) who visits our website and/or creates a Job Seeker account;

  • any person (Job Seeker) who registers to receive vacancy alerts via our website or; 

  • any person who works for a business (Recruiter) who is looking for staff and creates a Company account on the Website. 

This policy makes you aware of how and why your personal data will be used, how long it will be retained and your rights generally in relation to your personal data. It also provides you with certain information that must be brought to your attention in accordance with obligations under the DP Law.

Our commitment to you

It is our intention to at all times comply with the DP Law and principles, which means that your data will be:

  • Used lawfully, fairly and in a transparent way;

  • Used only for the purposes that we have clearly explained to you and limited only to those purposes;

  • We will only ask you for the minimum amount of information necessary;

  • Kept accurate and kept up to date;

  • Kept only as long as necessary for the purposes we have told you about; and kept securely.

Job Seekers - What we do

Registration with and use of the Website for Job Seekers is free. When you create a Job Seeker account, you engage with us to provide you with online recruitment services. 

The service includes providing you with regular bespoke updates of relevant vacancies which may be of interest to you. These updates will be provided as job alerts which we will email to you.

If you do not want to receive that information from us, we give you the opportunity to opt out both as part of the registration process and at any time by updating your contact preferences in your Job Seeker account or by clicking on the "unsubscribe" link within any email correspondence.

Recruiter - What we do

If you register on the Website as a Recruiter and create a company account, you will be required to provide us with personal and company data, we will process such personal data on the basis that it is necessary to do so in order to perform the contract you enter into with us. We may also contact you via email to invite you to review any services and/or products you received from us in order to collect your feedback and improve our services and products.

How do we collect your personal data?

We collect personal information about you from the following sources:

  • You, the Job Seeker or Recruiter via our online registration or contact forms;

Job Seeker - What data do we collect about you?

We may collect, store, and use the following categories of personal information about you:

  • The information set out in your CV,

  • Information to enable us to provide our services e.g. your date of birth and location, your preferred job location and the kind of work you are interested in,

  • General identification and contact information e.g. your name, residential address, email and telephone details,

  • Marketing preferences

We collect the personal data about you when you register with the Website. We do so in order to provide you with the recruitment services that are available through the Website as well as for administrative purposes. If you decide to upload a CV, cover letter, personal statement or other similar document or information we will keep that information for as long as you want to keep your account with the Website.

Recruiter - What data do we collect about you?

We may collect, store, and use the following categories of personal information about you:

  • The contact information you provide to us such as email address and telephone number in order for us to keep in touch and provide you with advertising services and information.

  • The information you provide on our application form, this includes your name, business address, telephone number, email address, other colleagues email addresses and contact numbers if you require multiple accounts.

  • Your business logo and company overview if you choose to include this in your advertisement.

  • Your current and previous vacancy advertisements to make it easier to re-advertise if you choose not to delete these via your account.

  • If you decide to advertise your vacancy through the Website you will be directed to a third-party payment provider (e.g Braintree / Paypal) to complete payment.

How will we use the personal data you provide to us?

For Job Seekers, we will use your personal data to supply you with the recruitment services that we provide including job alerts, to manage your account and to provide you with information about our recruitment services.

For Recruiters, we will use your personal data to supply you with the recruitment services that we provide including marketing activities on social media and email to manage your account and to provide you with information about our recruitment services.

The personal data which we collect about you, satisfies the following lawful conditions:

  • You (the data subject) have requested, or given consent to the processing of the personal data, for the purpose for which it is processed;

  • The processing is necessary for the performance of a contract to which you are a party or that is in your interests; and

  • The processing is necessary for the purposes of legitimate interests.

Marketing

From time to time, we would like to tell you more about the other goods and services available through the Website. We will do this by sending you marketing emails if you subscribe to them when you sign up to the website (by ticking the relevant box where indicated). You can subsequently unsubscribe by clicking the unsubscribe link in every subsequent marketing email.

We use tracking pixels in our marketing emails. These pixels provide us with information in relation to your interaction with the emails (e.g. if you opened the email). This information helps us to better understand how customers engage with our content and to analyse the effectiveness of our marketing campaigns. You can disable tracking pixels by changing your email settings to block the loading or display of external images. 

What happens if you don't want to provide us with your personal data?

If you fail to enter information in order to set up a Job Seeker or a Company account online when requested, you will be unable to save and set up that account and therefore unable to use our products and/or services. 

Who do we share your personal data with?

Once you apply online for a vacancy you are interested in, your CV, name, email address and telephone number will be sent to the Company who is advertising the vacancy. 

We don’t share, disclose or transfer your personal data with third-party service providers.

The Website will not transfer or sell your personal data to any third-party unless you have specifically consented to this. 

In the event of a sale or potential sale of the Website, or where it is merged with another business, your details may be disclosed to our advisers, and any prospective purchasers and their advisers, and will be passed on to the new owners of the business. 

In the unlikely event that a transfer of data is necessary outside of Guernsey and/or the European Economic Area to a country that does not have an adequate level of protection for your personal data, The website will ensure that additional explicit consent is obtained from you or safeguards are put in place to ensure the protection of your personal data.

Where do we keep your data?

Data submitted to the Website will be securely stored in the Website hosting infrastructure maintained by Digital Ocean. If you advertise a vacancy, data will be stored with the third-party payment provider, Braintree.

If you email us for support or details about your account data will be stored on Fastmail’s cloud-based systems.

How do we keep your personal data secure?

We have appropriate security measures in place on all hardware and software to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed.

Data privacy and data security is a priority for Braintree, and they are compliant with data protection legislation in the countries they operate in. Braintree will always treat data as required by law, and in fact exceeds those requirements significantly in most of the countries they operate in. Data Privacy is a key concern at Braintree, and they assure you that your personal data will be treated in line with their strict privacy and security controls, and will not be used in any unauthorised way.

Jobs operates a paperless office and we do not store data locally. Any confidential documents we receive in the mail are scanned and shredded securely.

We have procedures in place and employees trained in line with the DP Law to deal with any suspected data security breach and will notify you of a suspected breach where we are required to do so.

How long will we keep your personal data for? 

If you decide to upload a CV, cover letter, personal statement or other similar document or information we will keep that information for as long as you want to keep your account with us. 

Right to withdraw consent and close your account

By opening an account (as a Job Seeker) or (as a Recruiter) with Jobs, you provided consent to us processing your personal information for the purposes of job or employee finding services. You have the right to withdraw your consent for processing for that purpose at any time. To withdraw your consent, log into your account and hit the ‘close account and delete data’ button - will there be something like this? Alternatively, email us on [email protected] and once we have confirmed your identity, we will close your account and dispose of your personal data securely.

What are my rights?

You have the following ten rights under The Data Protection (Bailiwick of Guernsey) Law, 2017. 

  • 1. Right to information about why personal data is collected from you. When you are asked to provide any information about yourself to us we have a legal requirement to make it clear who we are and what exactly is going to happen to your data – in legal terms this is known as ‘fair processing information’. Source provides this information above in this privacy notice.

  • 2. Right of access. This entitles you to ask what data we hold about you and why by submitting a ‘subject access request’. 

  • 3. Right to object to processing for direct marketing purposes. If we use your personal data to market products or services to you, you have the right to tell us to stop. You are able to manage this yourself by unsubscribing otherwise email or call us directly, we must stop sending you material when you ask.

  • 4. Right to object to processing on grounds of public interest. Broadly speaking, this means that if we say we are processing your personal data because it is in our ‘legitimate interests’, or in the public interest, you have the right to ask us to stop. However, we can refuse your request if we can prove our reasons outweigh your reasons for wanting us to stop. Source does not currently use any personal information in this way.

  • 5. Right to object to processing for historical or scientific purposes. If we are using your personal information for historical or scientific purposes, you have the right to ask us to stop. Source does not currently use any personal information for historical or scientific purposes.

  • 6. Right to rectification. If we have information about you that is not factually correct or accurate you have the right to ask us to correct it.

  • 7. Right to erasure. This right is sometimes called the ‘right to be forgotten’. In certain circumstances, you have the right to tell us to delete your information from our records entirely.

  • 8. Right to restriction of processing. In certain circumstances, you have the right to tell us we can only use your information for a specific purpose, or purposes.

  • 9. Right to not be subject to decisions based on automated processing. This means you have the right to ask for a human being only to make decisions about your information. This is to avoid the “computer says no” scenario whereby you may be refused a product or service solely based on an algorithm, or other automated decision-making process. Source does not currently use any form of automated processing.

  • 10. Right to data portability. This means you can ask us to remove your information from our systems and give it to you in a format that is ‘machine-readable’ so that it can be easily transported and entered into another organisation’s IT system.

Access to your information and correction

We want to make sure that your information is accurate and up-to-date and will delete or amend any information that you think is inaccurate. Should you wish to make any amendments please sign into your account and update your information. Alternatively, you can email us at [email protected] and we will make the changes for you once we have confirmed your identity. 

We aim to provide you with useful work-related services for the whole of your career. However, you have the right to close your account at any time and have us delete all of your personal information unless we are in the process of responding to any complaint that you make.

Changes to the privacy notice

If we change or update our privacy notice, we will post those changes on our website with links on all other automated communications, so our users are always aware of what information we collect, how we use it and under what circumstances, if any, we disclose it.
